1 Validity and conditions


The General Terms and Conditions, hereinafter referred to as "GTC", shall apply to all transactions concluded via the online store www.tenawave.com. With the order of the goods or services, these terms and conditions are deemed accepted.


TENAWAVE reserves the right to change these terms and conditions at any time. The version of these terms and conditions in force at the time of the order shall apply.


Deliveries are free of charge to addresses within Switzerland or if the order value exceeds CHF 80. Otherwise, the delivery costs are a flat rate of CHF 8.-, if the delivery is possible in the corresponding country / region. The offer is valid as long as the product can be found in the online store and is in stock.


2 Information


2a. Products and prices


Images of products may differ from the original product and are therefore not binding. The prices valid on the day of the customer's order apply, unless otherwise expressly agreed in writing. All prices are inclusive of statutory value added tax and, if applicable, inclusive of prepaid recycling charge ("vRG"). All packaging (crate, pallet, foil, carton) shall become the property of the Customer. TENAWAVE reserves the right to change prices at any time. The price in the online store at the time of the order is decisive.


TENAWAVE delivers by Swiss Post to your home or delivery address. For deliveries within Switzerland, TENAWAVE delivers free of shipping costs.


2b. Availability and delivery time


All information on availability and delivery time are without guarantee and may change at any time. TENAWAVE assumes no liability for delivery.


3 Conclusion of contract


The prices and offers indicated in the online store are not binding. The offer is always subject to the contract dissolving condition of an impossibility of delivery or an incorrect price. The contract is concluded as soon as the customer places his order in the online store.


The arrival of an online order is indicated to the customer by means of an automatically sent order confirmation to the e-mail address provided by the customer. Receipt of the order confirmation does not constitute a promise that the product can actually be delivered. It merely indicates to the Customer that the submitted order has been received by the Online Shop.


The contract is therefore concluded only on condition that delivery is possible and that the price is correct.


4 Delivery date


Orders are usually processed on the working day following their receipt. The delivery dates can be seen in the online store and are confirmed with the sending of the order confirmation. If changes to the delivery time occur after the order, the customer will be informed. If TENAWAVE is in default of delivery, the customer (except for special orders) has the right to withdraw from the contract after 30 calendar days. In this case, TENAWAVE will refund the customer the amount already paid in advance. If the ordered delivery is already on its way, the customer may request a price reduction.


5 Delivery


The delivery will be sent directly to the end customer by our suppliers. TENAWAVE has no influence on the delivery time or the type of transport. Orders within Switzerland will be delivered directly by the Swiss Post.


6 Defects / Exchange


Complaints must be made within 14 days after receipt of delivery. With justified complaints the customer is entitled to one of the legal guarantee claims after TENAWAVES choice (return, reduction, replacement).


The postage for a possible return, for the purpose of exchange or repair of the defects, you take over as a buyer.


Exchange/return only in case of defects, wrong delivery or defective goods possible.


7 Liability and exclusion of liability


Liability is governed by the applicable statutory provisions. However, TENAWAVE is in no case liable for (1) slight negligence, (2) indirect and consequential damages and lost profits, (3) unrealized savings, as well as (4) damages from delay in delivery, as well as (5) any acts and omissions of the auxiliary persons of TENAWAVE, whether contractual or extra-contractual.


No warranty is given for defects and damages resulting from unsuitable or improper use, natural wear and tear or aging, or other interventions by unauthorized third parties, non-compliance with instructions for use or incorrect or negligent handling.


The buyer is aware that with natural materials such as steel, wood, cotton, yarn, printing, plastic patterns certain deviations - e.g. in shape, color and structure and the like - may occur compared to product images, which do not constitute defects.


8 Payment variants


Payments can be made only in the payment methods and currencies listed on TENAWAVE.


As payment methods bank transfer, credit card (Mastercard, Visa, AmericanExpress), Paypal and BitPay are accepted. The current fees can be seen under payment options and are shown in detail in the ordering process.


If payment is made by credit card or Paypal, the charge will be debited when the order is placed.


9 Data protection


All information on data protection can be found under the menu item Privacy Policy.


10 Final provisions


These General Terms and Conditions contain all rights and obligations of the contracting parties. Other agreements or declarations of intent by the contracting parties must be in writing to be legally effective - subject to the provisions of item 2 above. This shall also apply to any amendment of the written form requirement.


Place of jurisdiction is the domicile of the private customer in Switzerland or - for business customers or private customers who do not have a domicile in Switzerland - the registered office of TENAWAVE. Deviating national regulations remain reserved, which are mandatory applicable to consumers or consumer contracts.


Swiss law applies exclusively, to the exclusion of conflict-of-law rules referring to foreign law of the Swiss International Private Law (IPRG) or international treaties. Deviating national regulations, which are mandatory applicable to consumers or consumer contracts, remain reserved.


Should any of these provisions be invalid, this shall not affect the validity of the remaining provisions. Ineffective provisions shall be replaced by such effective provisions that come closest to the intended economic purpose.
